The goods will be delivered under incoterm 2010 FCA, unless otherwise stated. The Customer will bear the costs of shipping and all additional packaging (e.g. wooden shipping crates).
All taxes, duties and other charges are to be borne by the Customer.
From the time of handover of the goods to the carrier, the Customer shall bear the risk for the goods. This also applies to partial shipments. If the Customer refuses to take delivery of the goods shipped, PALFINGER shall be entitled to withdraw from the contract after an additional period of two weeks and to claim damages for non-fulfilment of the contract; alternatively, PALFINGER shall be entitled to hold the goods at the cost of the Customer and insist on completion of the contract of sale.
PALFINGER shall do the utmost to uphold the confirmed delivery periods. In the event of a failure to comply with such term of delivery, the Customer shall nevertheless not be entitled to claim compensation for damages.
